The single bench headed by justice Pratibha M Singh of Delhi High Court has issued a plea giving notices to Delhi government, bar council of India and the bar council of Delhi and had challenged the Delhi government chief minister advocates welfare (DGCMAW) for neglecting advocates for the voter's list who are not beneficiary and allowing only beneficiary advocates in the voter's list of Delhi. the writ petition regarding the same was filed by Mr Govind Swarup Chaturvedi and the court in the writ petitions states that all the advocates that are enrolled with the bar council of Delhi enjoy welfare scheme and need to be benefited to vote. Earlier when the notification was out on March 17, it was mentioned that those advocates who are in the voter's list of Delhi will only be able to avail the aforesaid benefits. It was contended in the petition that the online form for the submission contained one of the mandatory column named as 'Delhi voter ID card No,' and according to the petitioner, this is violation of article 14 and article 21 of the Indian Constitution because it is very discriminatory in nature and is absurdity and the violation of the principle of natural justice. Moreover, the petitioner head challenges the legal ATI of the notification that was issued arguing that it is not rational or reasonable ground exempting non voter from the welfare scheme. The petition also says, “clearly the said eligibility condition to exclude the non-voters is an illegal and ultra virus as well as inequitable as all the advocates registered with the respondent No.2/bar council of Delhi are playing same rule for rendering the services for dispensation of justice in the courts at Delhi and are contributing in the same manner to the society”. Therefore the petition has demanded that the benefit of voting has to be extended to all the advocates who are registered with the due process under the provisions of the bar council of India regardless of the fact that whether they are registered with voters of Delhi or not.
