The Allahabad High Court, in the case of Shaad Anwar v. The State of UP, on Friday directed the Uttar Pradesh Government to inform the court with the current status of the members of Tablighi Jamaat, who were put into quarantine after they arrived in the state. The petitioner alleged that the basic rights of these individuals were being compromised without even any viable justification. The petition requests the Allahabad High Court to issue directions to the State Government in the same concern, as allegedly a grave violation of fundamental rights of a group of individuals is taking place at the hands of the UP Government because of its laxity in issuing any further order or direction in the same matter. The bench of Chief Justice Govind Mathur and Justice Ramesh Sinha heard the petition and asked the UP Government to:
"make available all details pertaining to the members of Tablighi Jamaat, who were quarantined, released after completing the quarantine period or have yet not been released despite completing tenure of quarantine."
The instruction was passed in a PIL moved by Shaad Anwar, who is a Delhi-based legal practitioner. He filed this petition in order to call the attention of the judiciary to the issue that all the individuals from Tablighi Jamaat who were quarantined by the state Government have finished the endorsed Quarantine time frame however the State, with no reasonable and legitimate explanation and infringing upon the right to life and freedom of such individuals ensured under Article 21 of the Constitution, isn't discharging them. Reacting to these claims, Additional Advocate General Manish Goyal presented before the Court that a considerable lot of such individuals were remaining at the quarantine center at their own will due to non-accessibility and non-availability of transportation from the State of Uttar Pradesh to the State to which they have a place. The court has now asked the Government to specifically furnish the reasons or rationale behind not discharging these people, if there are any.
