On Friday, the Delhi High Court gave an instructions to advocates to close windows of meetings that they might have opened before the hearing to prevent any technological glitches during virtual hearings. The order was passed in consequence of the technic The Single Judge Bench Justice Pratibha M Singh passed this way to ensure successful virtual hearing by preventing the lawyers from being locked out and enabling them to enter the hearing when it starts. All issues faced by the Respondents' counsel in the case of Jasdan Energy Private Limited v Inox Wind Limited & Another.
Pursuant to Section 29A of the Arbitration Act , 1996, an appeal requesting an extension of time was filed, and the Court disposed of the same. Nonetheless, due to some technical problem the lawyer of the respondents was unable to sign in. The lawyer asked the Master of the Court for the same but an order was uploaded afterwards. Learned counsel submitted a letter to the Court before requesting a report from the IT Department.
The IT Department found that the lawyer of the respondents was attempting to attend the meeting prior to the scheduled date. It also clarified and guided what counsel should consider avoiding such breakdowns.
The report said:
"2. If any participant tries to join the meeting before the scheduled time he gets an error message and the same is saved in cache memory of the system. So after starting of actual meeting the user needs to close the old tab and again join the meeting. If the user does not close the old tab and tries to join the meeting from new tab the error message display asking the user to leave previous meeting. Advice – wait for call from court staff to join the meeting or check the display board available on the DHC website"
The Court believes that appearance of a counsel is crucial to the case and since the Respondents' counsel was prevented from appearing due to no fault of his own, the appearance of the Respondent's counsel be added to the last order and a correct order be uploaded as a corrigendum.

It is advisable that counsel should not hold open or live the old window, and close the same before logging in again. This order is to be transmitted for dissemination among its members to the Delhi High Court Bar Association, as it is likely that other lawyers might have faced similar difficulties in logging in.
