The Patiala House Court granted bail to ex-Congress Municipal Councillor Ishrat Jahan, who was arrested in February 2020 on grounds of marriage for committing communal violence in northeast Delhi. Additional Sessions Judge Dharmender Rana has permitted the release of Jahan on 10 days of interim bail from June 10 to June 19, so that she can attend her June 12, 2020 marriage event. Special Cell, Delhi Police has verified the details of her marriage.
Jahan, also an Advocate, was arrested on February 26, 2020 by Delhi Police for provoking a mob and raising slogans of independence during the anti-CAA protests in Delhi.A further FIR was subsequently filed against her under various sections of the IPC, UAPA, Arms Act and Prevention of Damage of Public Property Act.
As per the interim bail plea filed through Advocates SK Sharma along with Lalit Valecha, Tushar Anand and Rahul Sharma, her marriage was already fixed with one Farhan Hashmi, for June 12, 2020.
The plea also claimed that she was simply a supporter of the ongoing peaceful demonstrations, and was wrongly implicated in that event. It was argued that, according to Article 19(1)(a) and (1)(b) of the Constitution, she had the constitutional right to dissent from any arbitrary steps taken by the Government.
"The applicant has committed no offence whatsoever, and the wild and baseless allegations being made against her are not only irresponsible and false, but have also caused serious harm to her reputation…At the bare perusal of both the FIRs, no overt act and no specific role has been ascribed to the applicant except allegedly making a statement "will die but will not move from the protest site . whatever the police do"," her bail plea read.
Her lawyers also argued that she had cooperated fully during the investigation and was no longer expected to be kept under judicial detention as evidence, if any, had already been obtained by police during the investigation to support the estimation of alleged offences.
The court granted her temporary relief from furnishing two Rs 1 lakh guarantees, with a direction not to adversely impact the witnesses in the case with any proof or power.
Significantly, Jahan was granted bail by ASJ, Shahdra, on March 21, 2020, after acknowledging "that she had not been overtly charged with encouraging the crowd to take the law into their hands and use force against the police." However, on the same day, another FIR was registered against her for investigating the same alleged crime, "making the investigation agency a mockery of the judicial system," the bail plea states.
