The Bombay High Court has allowed the cruise ship MV Karnika which is currently anchored at the Mumbai port after it was placed under arrest to move it to safer waters due to the Cyclone which is going to hit Maharashtra coast today.
The vessel was placed arrested on March 17th 2020 due to a financial dispute between the owners of the cruise.
On Tuesday, Justice AK Menon heard the matter and the application filed for moving the cruise to safer waters as the projected trajectory of the cyclone suggested that Mumbai region and the ports of Maharashtra will be affected before heading to Gujarat.
Due to the large size of the vessel, it may be affected and damaged by the cyclone. Thus, the company of the ship sought the permission of the Court.
According to the plea, MV Karnika is a 14-deck passenger cruise ship which has over 63 crew members on board. The Bombay Port Trust advocate also filed an application stating that due to the large size of the cruise, it also poses a great danger to the other ships docked in the ort. It is thus, necessary to move the cruise.
After analyzing the arguments and contentions, the court deliberated that the impending cyclone and weather will affect the cruise and port. No number of tugs will be able to control the cruise.
Thus, Justice Menon permitted the ship to be transported to safer waters for the safety of the crew members and the ship as suggested by the port trust. The court also accepted an undertaking which was submitted by the owner M/S Jalesh Cruises Mauritius Ltd that the cruise will be brought back to its original position once the cyclone passes. It also asked the current port members and it’s chief officer and staff captain to surrender their passports to the port trust.
