It has been almost two months since the lockdown has been imposed and everything has come to a halt after the spread of COVID-19 across the globe. The situation has affected every sector of the country whether it be financial, educational or legal. The judiciary sector has faced a lot of problems in rendering justice has physical Court hearings were not allowed. Recently a letter was received by Chief Justice of India SA bobde which was sent by The Supreme Court advocates on record association (SCAORA) urging him to restore the workings of the courts and open the courts for physical hearings from July 2020 as there has been 'n' number of problems in rendering justice via video conferencing or in virtual Court hearings. The letter highlighted the Indian legal system as the body of Nation and open court hearings as the ‘spine' and said that the virtual courts cannot be a substitute to the physical courts. The letter intended to draw attention towards the physical difficulties that are faced in virtual Court hearings and hearing the cases online via video conferencing due to lack of proper Technology, lack of infrastructure, financial constraints and many other factors that pave the way for the citizen to compromise with Justice. Further, the letter states that almost 95% of the lawyers are not satisfied with the workings via video conferencing and are now requesting to resume the physical Court hearings with all precautions and all equipment’s needed to stop the spread and said “the common feedback seems to be that the lawyers are unable to present the cases effectively in virtual medium and the same is acting as major deterrent followers to consent for such virtual hearings”. The letter also pointed out many difficulties that are faced in hearing cases online all the system of e-courts. The association through this letter has also expressed his concern about the COVID-19 pandemic and further has expressed his gratitude and seriousness to take all the precautionary measures so that justice can be ensured even in difficult situations.
