An Advocate Kushagra Kumar filed a plea in the Delhi High Court. He challenged the decision of the AAP-led Government for sealing the borders of Delhi. The borders were sought to be sealed for one week, amidst the COVID-19 pandemic lockdown. He said the order to seal the Delhi border is illogical, unconstitutional and unreasonable. The Articles 14, 19, and 21 of the Indian Constitution have been violated. The petitioner asserted Delhi is the national capital of India and it has centrally funded hospitals like AIIMS etc. The Delhi Government has taken away the rights of those working in Delhi to avail medical facilities. The citizens in Uttar Pradesh and Haryana are also denied the basic right to access the hospitals.
The plea stated there is no dual citizenship in India. Everyone is the citizen of the country. It is a fundamental right to reside in any part of the country and avail the medical facilities at the affordable places. It is unconstitutional to deny treatment to the citizens residing inside and outside the area of the national capital. The order of the Delhi government is illegal, unjustified, and inhuman. Instead of improving the medical infrastructure and working towards the distribution of medical facilities, the Delhi government is sealing the borders.
It is preventing the individuals from all over India to avail the medical facilities of the prestigious institutions. The citizens are being denied basic amenities under the garb of the COVID-19 pandemic restrictions. The individuals residing in Noida, Gurugram, Uttar Pradesh, Haryana, and other areas of India will be unable to avail medical facilities provided by the Central government in Delhi. It will lead to chaos and dissatisfaction amongst the individuals. The step is not a welfare –oriented one. The fear of spreading of the infection cannot deny the citizens of India to undergo treatment in the institutions of their choice. The plea is sought to be heard on June 4.
