The National human Rights Commission has put forth an application probing to intervene in the case of Suo Moto cognisance taken by the Apex Court of the country in relation to the conditions of the migrant workers and how they are stuck in different parts of the country due to Covid-19 lockdown. With the help of this application, NHRC aims to examine laws that govern the protection of human rights of the migrant workers and also suggest some measures to ensure that the same are held up. The NHRC was established in the year 1993, primarily to protect and promote human rights and the application so filed is in the furtherance of the same.
NHRC stated that its function is to “intervene in any such proceeding that would involve any violation of human rights, pending before the court”. It is also meant to review the safeguard given and laid down by or under the Constitution of the country or any other such law that is in force at the moment. It also deals with the recommending measures for the efficient implementation.
The Commission informed the Court that on the basis of certain reports, it has decided to take Suo Moto cognisance of the migrants in numerous cases. It has also issued a notice to different state governments and departments, procuring certain details on what action they have taken to ensure that their basic human rights are protected. It asked for details on the distribution of food, water and other basic facilities to all those who have been suffering in these challenging times of a pandemic and a lockdown.
NHRC specifically asked for details of 6 incidents where they felt that they needed to step in due to clear human rights violations. It also issued notices to specific authorities in separate cases.
