Curbs on interState movement against MHA guidelines
In this worst time where people are away from their resident and willing to go their birth place or where they live so due to this pandemic there is very problem while going from one state to another due to not spread of viruse. Noting that the common man should not suffer, a Bench led by Justice Ashok Bhushan said the Centre and the three States should meet and decide in a week on a common pass system. “The petition says that in the NCR there should be one policy, one pass recognised by all the three States to avoid confusion, difficulty to common man... Convene a meeting of the States’ officials and endeavour to find out a common programme with respect to interState movement in the NCR,” the court ordered. Justice Bhushan said unless there is a common system in the three States, they would pass contradicting directives and the Centre’s guidelines on movement may become redundant. Gurugram man’s petition The court was hearing a petition filed by Gurugram resident Rohit Bhalla who alleged that “complete sealing of borders” within NCR and curbs on movement of citizens were in violation of the new guidelines of the Ministry of Home Affairs. The plea sought to declare as unconstitutional the measures adopted by the district administrations of Haryana and U.P., which allegedly restrict movement for permissible activities due to “blanket orders of sealing borders without reasonable exceptions”. Mr. Bhalla’s petition referred to the April 29 order of Gurugram and Sonipat districts in Haryana, and the May 3 public statement by the district administrations of Gautam Buddha Nagar and Ghaziabad in U.P. It has sought directions to the three State governments of to set up a mechanism for movement passes , as per the MHA’s guidelines.
