An Advocate Anindya Sundar Das filed a petition in the High Court of Calcutta seeking directions to the respondents to take necessary steps so that a proper surveillance by the police on the markets, offices and other establishments can be ensured. The plea further stated that by relaxing the lockdown, the Government has risked a considerable number of lives of individuals. A Proper surveillance has not been carried out by the State Government in various districts. The petition sought the directions to undertake necessary steps to keep the migrant labourers under a strict surveillance of the law enforcement agencies. These are those migrants who are returning to West Bengal.
It is alleged that the cases of the COVID-19 have increased since the arrival of the migrant labourers. No efficient step has been taken to undertake surveillance systems by the authorities. When the lockdown was announced on March 25, 2020, India had about total 618 confirmed cases of the CORONA-19 and death toll was around 13. In the present circumstances, India is the 7th most affected Country in the World. Despite such deteriorating conditions, the Government intends to unlock various establishments, institutions and private places. The petitioner reiterated that the Government of West Bengal has failed to implement the precautions and the guidelines required in the Lockdown. The people have not been following the norms of social distancing in the markets properly. This is because of the lack of vision of the Government and now the public is suffering in the pandemic crisis.
The High Court of Calcutta directed the Centre and the West Bengal government to file an affidavit regarding whose opinion was taken into consideration while relaxing the guidelines of the COVID-19 lockdown. A Bench of Chief Justice of Calcutta HC Thottathil B Radhakrishnan directed the West Bengal state Government to file the said affidavit by June 11.
