On Wednesday, Kerala High Court took suo moto cognizance on tribal youth Madhu’s murder which is based on a letter written by Justice Surendra Mohan to Chief Justice Antony Dominic. The government has been asked to file a reply within 15 days on the issue. The above direction to government is been given by Division Bench comprising Chief Justice Dominic and Justice Dama Sheshadri Naidu.
Looking back into the incident which took place on February 22 wherein a 27 year old tribal youth Madhu was beaten to death by a mob at Kadukumanna hamlet in Attappady, near Palakkad.
In the letter to CJ, Justice Surender Mohan quoted that “it was a sad reflection of the decline in the moral values of our society that projects itself as the most literate in the country”.
The letter highlighted the plight of education system which has led us to beat the victim on the allegation that he had stolen a small quantity of rice. In spite of numerous schemes which are been implemented by the state agencies, seems to be unreachable to a needy who is forced to steal food for his survival.
The Justice in his letter has also observed that the incident is an eye opener towards the atrocities to which the tribals of our country are subjected too. Therefore, it an absolute necessity for the government to issue more stringent laws to prevent atrocities against the tribal’s in our country.
According to Justice Surendra Mohan, such kind of incident “are blot on our society and State as a whole and we are all forced to hang our heads in shame, that such an incident has taken place in our State that boasts of 100, literacy”.
The victim was said to be mentally ill and if looked upon the gravity of the situation it adds to the culpability of the crime. He was attacked and lynched by a mob that showed scant amount of respect to law. There has been a serious lapse on the part of the law enforcement machinery which cannot be neglected easily. An effective investigation and whole hearted prosecution of the offenders is need of the hour.
