Recently, The Supreme Court took the prolonged matrimonial litigations into consideration by giving them permission to divorce by mutual consent and closing the cases. A Bench comprising of Justice Kurian Joseph and Justice Mohan M Shantanagouder was under the investigation of an appeal against a judgment of the High Court of Andhra Pradesh and Telangana. The assistance of Additional Solicitor General Mr. PS Narasimha was sought by the Supreme Court. The Couple was aided by the Bench in such a way that they were also provided with custody and visitation rights which were written in a form of an agreement and recorded and was taken into consideration as a part of the judgment of the Supreme Court. Added to this, the bench held that both the parties including their families to not file any petition against each other regarding the settlement without the permission of the court. It had also held that the custody processing which was pending before the Family Court in Hyderabad would stand disposed of based on the above-mentioned terms of the settlement.
The Court, later on, realized that it had taken a decision without being manipulated by any extraneous factor. Accordingly, The marriage between the couple was dissolved by a verdict which gave consent to divorce by mutual consent as per Section 10A of the Indian Divorce Act, 1869.
