Recently, A Divisional Bench of Justices of Justices Mr. Sanjiv Khanna and Mr. Chandra Shekhar had been hearing plethora number of petitions challenging the notifications. The Delhi High Court had stayed the CBSE notification pertaining to NEET 2018 where it had introduced the upper age limit of 25 years for the unreserved candidates and 30 years for the reserved class. The Delhi High Court had also stayed the notification which was based on barring the students from Open Schools (NIOS) by impeding them from participating in the NEET 2018. When the petitioners had approached the Supreme Court regarding the upper age limit, the Judges of the Divisional Bench i.e., Justice SA Bobde and Justice L Nageswara had given permission to withdraw the petition and move it to the High Court.
It was brought to notice that out of these petitioners, one of the petitioner named Jasna who was a professionally trained nurse, had contended that her opportunity to appear for NEET 2018 was denied by the Central Board of Secondary Education (CBSE) as the age limit imposed for the reserved category was not only arbitrary but was also unreasonable. The petitioner had further contended that the said age limit for the reserved category was set and imposed after the issuance of a notification by the Medical Council of India (MCI) as on 22nd January 2018 in order to amend Regulation on Graduate Medical Education, 1997. Added to this, The petitioner referred to the prospectus issued by the Office of the Controller of Entrance Examinations, Government of Kerala as on 30th January which was regarding the admissions to Professional Degree Courses, 2018. According to the prospectus, the petitioner should have been eligible except for the age limit set by the CBSE in NEET. The Petitioner had also made a detailed submission about the cycle that each one faces after their graduation and how much time it takes for them to complete it. Finally, the petitioner had stated about the delay and apathy of the Government and how the penalty is paid by the petitioner by not being able to apply for NEET 2018.
