The University of Kerala tells HC that it has taken a decision to conduct additional examinations for those candidates who cannot appear for the examinations scheduled on July 1 due to pandemic related to difficulties. Such exams will be treated as ‘special examinations’ and no additional fees will be conducted for the same and these examinations will not be treated as the supplementary examinations but they will be the normal examinations.
Kerala University has cleared that these examinations will be scheduled from July 1. However, the court directed to the vice-chancellor of the university to take the decision by today on the file of the representation by the petitioners.
The single bench of Justice CS Dias, who considered the pleas, ordered:
“As the scope of the judicial review in the scheduling of the examination is very limited, and the fact that the students who are willing to appear and write the examination have not been impleaded at least in their representative capacity and since the examinations are to commence from July 1 and further for the elaborate arrangements ad reasons pleaded by the university in the arrangements and reasons pleaded by the university in the statements filed before this court and then he declined to pass the order and stay examinations from 01.06.2020.
There were two writ petitions in the court one filed by 23 PG students and the other filed by a sixth-semester law student of the Kerala Law Academy. Further, it has been also clarified that taking the examination will be wrong with the students because a minimum number of the teaching days should be 90 days and the teaching days was only 29 days due to suspension of the classes from March 9 and students are not having there all the study materials and few are in the contentment zone. It will be very risky for the students to get collected in one place.
Therefore, in reply to this University Advocate said the University has already conducted examinations for some undergraduate courses successfully from May 21 to June 15. He assured that all the safety measures will be taken. It was pointed out that the majority of the students are willing to give the examinations.
