Bombay High Court Stays FIRs Against Arnab Goswami: Says No Prima Facie Against Him
Bombay High court provides interim relief to Republic TV Channel Editor-in-Chief Arnab Goswami by staying two First Information Reports (FIRs) against him for his provocative remarks in a television debate on Palghar incident and gathering of migrants in Bandra west.
The division bench consisting Justices Ujjal Bhuyan and Riyaz Chagla, while staying the FIRs observed that there is Prima Facie no case made out against him, and no offenses disclosed against him.
The court observed that there is nothing to show that Arnab tried to cause public disharmony. Also, the court accepted the petition and said the interim protection from coercive steps will continue until further notice, the court gave this order on Tuesday against the pleas made by Arnab Goswami seeking various reliefs and quashing of the FIRs.
Arnab was booked in connections with the TV shows on 21 April and 29 April in regarding his questions on Congress president Sonia Gandhi over the lynching incident of Palghar and his comments regarding the gathering of migrants in Bandra railway station.
The two cases were registered under various provisions of IPC including the intent to cause riots, defamation, statements promoting enmity, criminal conspiracy, and ill-will between classes.
The Bombay high court observed that the transcript from the clip from his news show did not present any communal angle to the coverage, and emphasized on freedom of the press and consistent with its observation granted relief to him.
Earlier the Supreme Court had declined Goswami’s request to transfer the case to CBI but granted him interim protection from coercive actions, however, SC quashed the multiple FIRs from various states and confined the investigation to the FIRs lodged in Mumbai only and allowed him to move to High Court for quashing of FIRs
