On 29th June 2020, the Bar Council of Delhi addressed a letter to the Union Home Minister Amit Shah regarding the committee for reforms in criminal law. They sought the inclusion of representatives from the bar into the central committee for reforms. The members from Indian Bar Council and other state bar councils should be included in the high power committee so that their expert advice can be obtained to make the reforms.
Citing various examples from Nirbhaya to a half-burnt body at Hyderabad after the rape , the bar council of Delhi has pointed out the various flaws in the common law and criminal law system which was inherited from the Britishers. Even as per the CJI "Justice loses its character if it becomes revenge", therefore street trials are not legal in a democracy like India. The rule of law established should be so strong that everyone supports the same and restores their faith in the Indian Judicial system. "The Vulnerable sections of the society like women, children and weaker sections suffer since the system has failed to live up to people's expectations". Even though amendments have been made since the formulation of the laws, but they haven't helped in reducing the crimes.
"Neither people nor the criminal justice system has trust in police." This is largely due to the sluggish attitude, which leads to a lack of evidence and the person is acquitted. Even the recent use of street trials have eroded the public confidence of people in the police. Therefore, the need of reforming the same arises, wherein people have faith in the police as well as the legal backing of it. Appreciating the Government's effort in reviewing the existing criminal justice system laws, they have put forth the idea of taking up experts from the law field as well who have a good knowledge of the system.
The Bar Council of Delhi thus seeks representation of experts from the various bar councils in the committees which aim at reforming the existing criminal law and various other systems. This would help in laying down much better and efficient systems where speedy trials and justice is ensured and wherein the faith of the citizens is reaffirmed in the police.
