Due to the rising number of positive cases in Bengaluru, the High Court of Karnataka has decided to cancel the physical hearing of cases at the Principal Bench which is in Bengaluru. It issued a notice cancelling the physical hearing with effect from 30th June 2020. The physical hearing for limited matters were being conducted since 1st June but now stands cancel due to the alarming situation. According to the notice “only those bench which are already notified for hearing of urgent matters through Video Conferencing will function.” In addition to that the normal functioning of Dharwad and Kalaburagi Bench would continue.
The matters listed for 30th June would be taken up on 1st July 2020, whereas those mentioned for 1st July would be taken up on 2nd and 3rd July through video conferencing. Thus, reducing the physical appearance before the bench and complying with the norms of social distancing which is necessary to contain the virus. Moreover, this step was much required for as the number of cases in India has been increasing on a daily basis.
The notice has also requested the members of the bar to send requisitions for listing only matters which are extremely urgent. Due to large number of requests it becomes very difficult for the court to function and this may also lead to a stop in the functioning of the court. The court has also mentioned that the requests for listing would require 72 hours of processing opposed to the 48 hrs mentioned in the Standard Operating Procedure.
The court has also cleared that the appointments given for filing of cases and rectification of objectives on 2nd and 3rd July are not cancelled. Further the appointments provided for 30th June has been shifted to 3rd July as per their existing slots. The number of slots would also be reduced from the next week due to the alarming situation. The Principal Bench at Bengaluru and all other courts in Bengaluru Urban and rural districts have also been decided to remain close on 4th July.
