CENTRE DECLARES THE STATE OF NAGALAND AS “DISTURBED AREA” FOR 6 MORE MONTHS
The central government has declared the entire state of Nagaland as ‘disturbed area’ for a period of six more months with effect from 30th June’ 2020 till December end 2020, under Armed Forces (Special Powers) Act, 1958 (AFSPA).
The notification issued by the Ministry of Home Affairs states that the center is of the opinion that the area comprising the whole state of Nagaland is in such a disturbed and dangerous condition that the use of armed forces in the aid of civil power is necessary.
The government has made the declaration under the section 3 of AFSPA, according to which governor of the state or any administrator of the union territory of the central government is of the opinion that the state or a part of the state is so disturbed that the use of armed forces in aid of the civil power is necessary, then they can declare it by a notification in the official gazette.
Nagaland has been under the control of the Armed Forces (Special Powers) Act for almost six decades, it was not withdrawn even after the agreement was signed between the Naga insurgent group Nation Socialist Council of Nagaland (Isak Muivah) General Secretary Thuingaleng Muivah and government interlocutor R. N. Ravi in presence of Prime Minister Narendra Modi, on 3rd August’ 2015.
The decision to maintain the status quo in Nagaland regarding the coverage of AFSPA, a law slammed by many civil societies groups an ‘draconian’, came amidst the reports of deteriorating law and order situation there.
The AFSPA gave many powers to the armed forces in the state such as powers to search and arrest anyone and to open fire if they deem it is necessary to ‘public peace and order’.
