“Respondent wife being interested in remaining in her room or not showing initiative in doing household work can by no stretch of imagination be described as cruel behavior and that too upon the appellant/husband”, observed by the Delhi High Court.
The division bench of Justice Hima Kohli and Ashamenon was hearing the appellant husband being aggrieved by the judgement and the decree dated on 30.08.2019 of the family court, Dwarka dismissing his petition seeking dissolution of his marriage with the respondent under section 13(1) (i) and (i) and (ia) of the Hindu Marriage Act. But further it was cleared that this ground will be not said as available for this case.
From the affidavit filed the appellant husband, the bench opined that if was difficult to discern as to what conduct of the respondentno.1/wife impacted him as being cruel. Then further it was cleared that the respondent No. 1 wife has been-
Then further by the respondent party it was cleared as she was the new bride and the new member of the family so she feels hesitated in many of the things she should get some time in doing all of the things. But then on the hand the respondent the husband side has told that he was not told about his previous affairs as she was in the live in relationship and it will be said as adultery but later on again during the cross examination it was said that everything was disclosed before the marriage and relationship before the marriage will be said as just a relationship not adultery.
However, the appeal was dismissed on the grounds as there was no adultery and cruelty are there and the dissolution of the marriage has been cancelled and the high court has dismissed the appeal.
