‘IS THERE A PLACE FOR FICKLE MINDED OFFICERS IN THE PARAMILITARY’: DELHI HIGH COURT
The Delhi high court while hearing a petition of a Central Reserve Police Force (CRPF) seeking a withdrawal of his resignation asked as ‘whether there is place for the fickle minded officers in the paramilitary forces’.
The division bench of Delhi high court comprising of the Justice Rajiv Sahai Endlaw and Justice Asha Menon in the writ petition moved by the officer of CRPF challenging the order in which his resignation was accepted while seeking its withdrawal, observed that the prima facie the officers of paramilitary should not be permitted a sabbatical in this order.
The petitioner has pleaded that no decision has been communicated to him on his request of withdrawal of resignation on 8 May’ 2018 and reminder dated 28 February 2020.
The petitioner further contended that he has applied for withdrawal of his resignation under the Rule 26(4)(iii) of CSS Pension Rules 1972, within 90 days from the date of his resignation became effective, and hence is entitled to consideration of his request for withdrawal.
Though CRPF has recommended to the withdrawal of his resignation, as he has displayed exemplary service during the time of his employment as assistant commandant, but the central government has not responded to his request.
The court questioned that how can the petitioner be granted the relief of re-joining after been out of service for more than two years, and noticed that the petitioner didn’t approached the court immediately after no decision was communicated to him on his request of withdrawal of his resignation and waited for almost two years to send second request.
Despite putting these questions on petitioner, the court issued notice to respondents and now will take the matter on 17 August’ 2020.
