The Supreme Court on Thursday observed the affidavit filed by the Center in answer to the plea filed by foreign nationals who have been blacklisted by the Ministry of Home Affairs (MHA) for their asserted "Tablighi Jamaat Activities" at Delhi's Nizammudin.
The government told the SC on Thursday that foreign members from the Tablighi Jamaat who had indulged in religious activities while in the country on tourist visas would face consequences for their actions and cannot seek to be deported as a matter of right. They will likewise be boycotted to forestall reemergence in the future.
The bench headed by Justice AM Khanwilkar mentioned the objective fact during the hearing about a plea by 34 foreign nationals from different nations, who have challenged renouncement of their visas, expressing they had not indulged any genuine offense and had gone to the social affair before lockdown limitations were set up. The petitioners made a vehement appeal for their expulsion. "They can't be extradited if there are criminal cases pending (against them). It will be the central government's discretion".
"It is presented that grant of a visa not an enforceable right not to mention a fundamental right and visa is a privilege that any nation grants to an outsider. The said visa is consistently liable to singularly forced limitations and stays restricted singularly in the event of a brach. It is presented that no privilege of hearing can be perused into any indicated directly on part of the Petitioners under Article 21 and the privilege to life and freedom under Article 21 is consistently dependent upon the strategy set up by law. The ministry said that out of the total reported 2,765 instances of Foreign Tablighi Jamaat individuals, visas of 2,679 (counting nine OCI cardholders) have just been canceled.
It stated: "47 Foreign Tablighi Jamaat outsiders are Nepal nationals, who are not holding any visa. Visas of the staying 39 cases are under the procedure of undoing. Out of these 39 cases,
18 visas were given by Indian Missions and in 21 cases, the passport number gave by the originators weren't right/deficient and the equivalent has been looked for from the originator."
It was presented by the Center "grant of visa is a sovereign capacity of the middle. There is no option to be extradited. Expelling can be permitted if there is no criminal case. There are criminal accusations pending against them," solicitor general Tushar Mehta, speaking to the central government, told the court.
The Court will presently take up the issue on July 10
