The apex court of India on 4th July 2020 issued a circular stating the Standard Operating Procedure (SOP) for the purpose of Video Conferencing Hearing. In order to contain COVID-19, the Chief Justice of India has directed virtual courts from 6th July 2020. This circular superseded the earlier circulars dated 23rd March, 15th April and 16th May and elaborated SOP “foe e-filing, mentioning, listing and hearing of matters through video conferencing/ tele-conferencing mode.”
Regarding Listing of matters: The fresh matters may be listed from 6th July to 10th July 2020. From the 13th of July, miscellaneous cases are to be listed on Monday and Friday, notice matters may also be listed with fresh ones. On Tuesday, Wednesday and Thursday, “miscellaneous matters including final hearing matters and regular matters may be listed”. In both the cases preference would be given to part heard cases. The schedule for publication of cause list has been issued as well.
For joining of Video-conferencing: Option would be provided of either linking to the bench through personal laptop or for availing video conferencing facilities in SC premises. Web link for joining the same would be provided. In matters where AOR wants senior advocate to appear or a litigant to view proceedings the contact details should be sent to the email id video.conference@sci.nic.in.
Guidelines have also been provided for mentioning and e-filing, instructions for joining video conferencing through the VIDYO app. The AOR is required to file application preferably though the e-filing mode which is available on the SC website. The application should contain the contact details as well. Matters which are urgent shall be dealt on the basis of established guidelines available on the website.
The notification also lays down the step by step procedure to join the video conferencing hearings through the VIDYO app. The court has also emphasises on the need for strong connectivity having minimum 2 mbps or 4G data connection. The standard protocol of muting the mics and raising of hands should also be followed during the hearings.
