The vacation bench constituting of justices Adarsh Kumar Goel and Ashok Bhushan presented notices to the Centre, the CBSE and the Kerala government after the petition was filed by a faction of 170 medical aspirants. The students have showed defiance with the Delhi High Court's May 11 judgement shrugging off the supplications opposing the MCI announcement regarding the imposition of upper age limit. The Supreme Court entreated a respond from the Centre on a petition which challenged the Medical Council of India (MCI) as it laid down a standard basis of inflicting upper age limit of 25 years for general category students and of 30 years for students classified as the Scheduled Castes, Scheduled Tribes and Other Backward Classes as well as Physically Handicapped categories for admission to appertain for National Eligibility-cum-Entrance Test (NEET) for MBBS course.
The counsel who made an appearance for the students urged the apex court that the constraint of 25 years was entirely capricious and erratic. The counsel further importuned that the Regulation is faulty in accordance with the MCI Oversight Committee along with the Central government and suggested that the upper age limit should be expunged as the country is in grave need for more doctors. Earlier, the high court's decree had come on a handful of petitions moved by the medical students who were disgruntled and irked by various other eligibility guidelines excluding them to put in application for the NEET-UG. The Bench further scheduled the petitions for hearing in July.
