The Supreme Court on Monday dismissed a petition alleging that it adopts the method of “pick and choose” policy by its Registry and giving preferences to the influential advocates on the listing of matters.
The petitioner, Advocate Reepak Kansal claimed this allegation and had also claimed of this discriminatory practice adopted by the Registry and failed to get his petition listed despite giving a letter of urgency on record annexed with the petition and he then complained to the Secretary-General of the Apex Court via email but he did not get any response for it. He further added that it not only happens occasionally but happens routinely.
Here Advocate Reepak Kansal, made a reference to the case of Arnab Goswami, Republic TV editor-in-chief, being listed overnight.
The Petitioner’s plea concerning "One nation, one ration card" had not been listed by the Registry due to some defects in it. He had compared the listing of his own petition with the one filed by Arnab Goswami challenging the multitude of FIRs registered against him in various states. His plea was listed within a day and was taken up for hearing by the Court.
He further accused the Section Officers and the Registry department for showing partiality towards the famous law firms and influential advocates, who are best known to them. He further added that this is discrimination and is against equal opportunity given in this Hon’ble Court.
The Court took serious objection to this allegation and dismissed the petition filed by the petitioner. The Court during the hearing on June 19, 2020, orally stated that “How can you compare your Petition on One Nation One Ration Card to the plea of Arnab Goswami? What was the urgency? Why are you saying nonsensical things? All members of the registry work day and night to make your life easier. You are demoralizing them."
During the hearing, the Court also said that the Registry is the part and parcel of the Supreme Court, and not subordinate to the Judicial side.
The bench for this matter was headed by Justice Arun Mishra, he dismissed the petition filed by the petitioner and also imposed a minimum cost of Rs 100 on the Petitioner.
