The High Court of Judicature at Patna on Monday took suo moto cognizance of news published reports emphasizing the status of children from marginalized community being coerced to perform rag picking, beggary and scrap selling activities to fetch food as a substitute for mid day meal given by the govt.
In wake of covid 19 pandemic all the schools and anganwadis across the country have shut their doors abiding to govt's guidelines as a result there was complete pause in distribution of mid day meal which was a part of school routine. As an effect violated children's right to food which is one of the prime right which thereby led to depravity in health of children.
On July 6ht, Monday when Indian Express published an article illustrating the plight of children in Bhagalpur, Bihar who were choice-less and coerced to perform activities of beggary and rag picking. Patna high court in considering the most worst sufferers during the pandemic has taken suo moto cognizance of this case.
The bench stated that that is a matter concerning to welfare of the children from the lowermost strata of the society itself signifies the importance of mid-day meal as a part to lead their life as vast population depend on that scheme.
" The disruption and closure of foods across the state will have a negative impact not just on children's right to education but also in specific cases, their right to adequate food".
The court referred to Art 47 of the constitution of India which places a duty upon the state to raise the level of nutrition of standard of living. Further, section 5 of National Food Security Act which provides for nutritional support. The court insisted on implementing the same as such, issued notice to state of Bihar.
In response, state of Bihar sought two days time submit the detailed report on this issue. Court also appointed advocate Chayya Kirti as amicus curiae for this case.
