The SC demonstrated on 7 July that it was open to holding a day to day hearings over video for a case identifying with the Maharashtra law for Maratha community quotas, defying calls by advocates to start some in-court since the virtual medium is inadequate for the elaborate legal discussion that should be made in an issue that includes interpretation of the Constitution. The dates for the hearing will be given 1 month from now, the apex court said. Senior Adv. Mukul Rohatgi additionally supported a physical hearing of the case which has political importance in Maharashtra.
The Maratha reservation bill, which was passed by the Devendra Fadnavis-drove Bharatiya Janata Party (BJP) government in the state, was challenged in the apex court by one Jayashri Patil. Activist Vinod Patil, in the Maratha reservation development, has asked that the issue be referred to a five-judge bench. The applicants were challenging the Bombay High Court's decision to maintain the law by which the Maratha community would get reservations in jobs and education in Maharashtra. senior BJP leader Devendra Fadnavis on Monday said the state government must go fully prepared for the Supreme Court hearing.
"The case includes 15 petitions, the judgment of the Bombay HC which is under challenge runs into 500 pages. The state has documented a counter-affidavit which is more than 1500 pages. There are a few books, reports, and records that should be referred which is conceivable just in a physical court setting," said senior Adv. Shyam Divan, speaking to the petitioners. To this, the bench, led by Justice LN Rao, stated: "Expecting an immediate hearing for the case and that as well, judges assembling physically in the current circumstance (of Covid-19) probably won't be possible.
The issue identifies with a Maharashtra law that presented 13 percent quota in appointment to public service jobs and 12 percent reservation for Maratha people group in education in the state.
