The writ petition under Article 32 has been filed before the apex court by the Bar Council of India to bring in notice the plight of vast advocates especially young advocates who are being affected amid the lockdown from March 2020.
In the matter, Bar Council of India versus Union of India a writ petition filed under A32 states that "prolonged closure of the court and tribunals all over the country has resulted in depriving the majority of advocates their source of income".
" This has affected all sections of the profession and the younger and junior advocates are hit hardest financially. Large number of them have various commitments to meet apart from keeping their family together. The situation of some of them is so grim that it may not be an exaggeration to say that they face virtual starvation and they require urgent and immediate financial aid and succor" states the plea.
BCI further submitted the financial status, It is said that BCI's funds are barely "sufficient to meet its regular expenses".
The supreme court advocate S N Bhat representing vast population COVID hit (indirectly) pointed out " the proceeds of advocate welfare stamp duty collected at the time of filing of Vakaltnama in court goes to the coffers of government"
In due course, advocate S N Bhat sought directions to government authorities to provide loans up-to 3lakh free of interest repayable by at least 12 months after the normal functioning of courts begins in reasonable installments. Further, " It is now felt that assistance formulated by state bar councils are wholly inadequate looking at the enormity of problems faced by the lawyers".
Therefore, BCI has now urged SC to look at the plight of advocates.
