In the case of Birju v. East Delhi Municipal Corporation through the Commissioner & Anr. W.P. (C) 4009/2020, Justice Najmi Waziri of the Delhi High Court directed East Delhi Municipal Corporation (EDMC) to address the grievances regarding non-payment of Swachhata Karamcharis within eight weeks.
The petitioner has been represented by Advocate Roopa Nagpal. In this case, despite repeated requests has not been paid his salary "as per the regular pay scale". He has been deprived of his money by the EDMC for many months now. His representation dated 4th January 2020 did not yield any response from the side of the corporation.
The petition has been disposed of and the EDMC has been directed to respond to the petitioner's representation. Appropriate orders have to be passed by the Corporation within eight weeks and the decision shall be conveyed to the petitioner in the ninth week. The order shall also incorporate the amounts that are due to the petitioner, and the required money should be paid to him within 2 weeks of this order dated 8th July 2020.
If the petitioner is not satisfied by the order, he can recourse to appropriate measures that are available in law. The court has also pointed out that four similar orders have already been passed where the petitioners have had an identical position. The court also added that every aggrieved does not have to approach the court separately. So the court had directed EDMC to "ensure that grievances of all the persons who are similarly placed, are addressed and appropriate generic order in their regard may also be passed". The said order has to be placed before the commissioner of EDMC and a compliance report has to be filed within 8 weeks from the order. The petitioner has further been listed regarding compliance on 25th August 2020 and the Writ Petition has been disposed-off by the High Court.
