The Madras High Court on Thursday, considering the plight of labourers who are without food, directed the state government to provide them ration after satisfying that they are migrant labourers irrespective of the fact that they have Ration cards or not.
The division bench of Justice N. Kirubakaran and Justice V. M. Velumani observed that the state govt has announced that the ration supplies will be given to the ration card holders, and there are lakhs of migrant labourers who are without ration cards and they will not be provided the ration, the court also notice that the West Bengal government has announced that they would give ration to the migrant workers even without ration cards.
The court also observed the incident a migrant labourer’s pregnant wife, who was denied admission into a government as well as private hospital at the time of labour pain, just for the wants of corona free certificate, due to which she had to deliver the baby in an autorickshaw and during the process new born baby fell from the rickshaw and sustained injuries immediately after birth.
The court said that it is very unfortunate that the treatment was not given to the new born baby, and just because the parents are migrant labourers they cannot be denied of the medical facilities.
The bench directed that the authorities will trace the migrant’s family and give them the medical facilities necessary for them.
This order came in the hearing of a Habeas Corpus plea in respect of the bonded labour and alleged detention of 400 other labourers by police.
The Court noted that the Supreme Court in its Suo Motto cognisance “In Re : Problems and Miseries Of Migrant Labourers” gave liberty to the High Courts to proceed with the pending cases of migrant labourers.
“The aforesaid order has not been brought to the notice of this court while closing the Habeas Corpus Petitions.”, commented the bench, in reviving the aforesaid habeas pleas.
