The petition before the SC says that “ conducting exams during the pandemic COVID-19 not only but the health of the students in danger but also their families and communities at large.”
A student of class XII from the National Institute for Open Schooling moved to the SC seeking a direction for the cancellation of their pending exams. And also for the declaration of their results ( Neil Varun Namburu V. NIOS and others).
The petition for this case has been drawn by Advocate Prerna Singh, Arunabha Ganguly, and Guntur Pramod Kumar.
The petitioner is seeking directions from the SC to cancel their exams and declare their results in a manner similar to the way CBSE and ICSE were permitted to do or alternatively plan to devise a system for the special needs students of the NIOS. The petitioner is a class XII student through NIOS, who is planning to pursue his higher studies from abroad. The petitioner has already secured admission to two UK universities and is waiting for his class XII results. The course is likely to commence from September this year.
But due to the COVID-19 pandemic, some of the papers remained pending which were earlier scheduled to be held in the month of July and August. But now they have been postponed. The petitioner also highlights the risk of conducting the exams during this time.
The Plea states “it is submitted that conducting the exams during this pandemic poses the health and lives of the students to danger, their families and communities at large.”
The petitioner also points out at the critical health crisis which is being faced by the country during this time, the CBSE and the ICSE have devised a system for declaration of results and it was successfully permitted by the SC. This step taken by the various Boards has helped the students who have applied for higher studies not just in India but also abroad.
The NIOS caters to special needs students and the Divyang students, it has already canceled the remaining exams for these students. The petitioner has prayed the Hon’ble to direct NIOS to cancel the pending exams and also to declare the results of the students.
