On Tuesday High Court of Gujrat granted bail to 25 migrant workers, arrested on the charges of murder and dacoity, for their alleged clash with police personnel on 17 May’ 2020, over the delay of their return to their native states.
The single Judge Bench of Justice Gita Gopi observed that the allegations made in the said complaint reveal the fact that “ the sentiments of the migrant's labourers were at the all-time high on account of the situation prevailing” and that “they only wished to return to their native state as soon as possible” and that had failed to manage the situation properly, and observed that “the police had required to handle the crowd tactfully”
The court expressed the view that it would not be the intention of the migrant workers to murder the police officers and the injuries sustained by the officers were not life-threatening.
The labourers were arrested on the grounds of an attempt to murder and dacoity, punishable under the sections 143, 147, 148, 149, 269, 307, 325, 332, 337, 338, 395, 427, 431 and 188 of IPC, section 144 CrPC, section 43 of Gujrat Police Act, section 51 of Disaster Management Act, section 3(e) and 7 of the Prevention of Destruction of Public Property Act.
Police alleged that the uproar was for making arrangements for their return and that they denied leaving the school ground, where registration process for special ‘ Shramik Trains’ were going own, and then some of the labourers started misbehaving with the police officers and led to the instigation of the crowd and they started throwing stones and sticks to the police officers, and even the vehicles of the general public were destroyed.
The court noted that the local authorities were very much aware of the arrival of hundreds of migrant labourers at the ground and the police were required to work in coordination with the authorities but there was a lack of coordination between the police and the authorities which led to the ‘chaotic situation’.
