The Delhi High Court has given notification in an appeal seeking a direction to the Election Commission to de-register Andhra Pradesh Chief Minister YS Jaganmohan Reddy's Yuvajana Sramika Rythu (YSR) Congress Party.
The Single Judge Bench of Justice Jayant Nath sought responses from the Election Commission just as YSR Congress Party in the request moved by Anna YSR Congress Party.
It is the petitioner's complaint that regardless of the Election Commission banning Andhra Pradesh's ruling party from embracing the "YSR Congress Party" as its party name, the same is being done wrongfully and unlawfully in the parties' letterheads, campaign materials and different collaterals of party’s organization.
The applicant has attested that YSR Congress is a necessary piece of its "Anna YSR Congress Party", and that the party in power has been misappropriating the name before the world on the loose.
Contending that the YSR Congress is blameworthy of clear, wilful, pre-interceded, purposeful and cognizant insubordination to stick to legal headings and guidelines of the Election Commission, the petitioner has asserted that the YSR Congress ought to be de-registered as a political party under Para 16A of the Election Symbols (Reservation and Allotment) Order, 1968.
The petition was filed through Advocate Vipin Nair. The petitioner was spoken for by Senior Advocate Meenakshi Arora.
Election Commission was represented by Advocate Sidhant Kumar.
YSR Congress was represented by Senior Advocate Rajiv Nayar and Advocate Mohd Naaki.
The issue will be heard next on September 3.
