In the Supreme Court of India, an affidavit was filed by the Union Ministry of Health and Family Welfare (MoHFW).
After having meeting stakeholders as per the direction given on 14th July 2020, the center suggested some cost-effective treatment of COVID -19 patients across the states. It was informed to court that a personal hearing was accorded by Additional Health Secretary, Ms. Arti Ahuja, and petitioner (Sachin Jain) was also present at the hearing on 16th July 2020 and the written submission of the hearing were submitted at end of evening.
The report which is filed under the name of the Deputy Secretary, MoHFW states that in accordance with the suggestions given by petitioners and intervenors some non-mandatory guidelines may be issued to the state government. It is said by Centre that the health of citizens is the responsibility of the State and it has to work out according to the facilities available and the number of cases with government.
Centre states that "It is to be highlighted that Health is a State subject and primary responsibility in terms of management of COVID-19 rests with the States. Depending on the number of cases and the availability of health infrastructure in the government set-up". The Supreme Court on 14th July 2020 stated that it would not formulate a uniform and regulatory mechanism for the treatment of COVID-19.
Court also observed that as different states have different requirements and needs, it is not possible throughout the country to drop the cost of treatment for medical care. Centre suggested that some normative guidance may be provided to state so that it can arrive at reasonable rates to ensure that responsibility of treatment of COVID-19 is undertaken by private hospitals.
In the end, ten guidelines were suggested before the Supreme Court considering the present scenario. Thus the Centre is asked to place a decision within a week for approval of directions that are to be issued to various states under the Natural Disaster Management Act.
