On December 12th, 2019 Supreme Court appointed a three member inquiry commission consisting of former Supreme Court Justice VS Sirpurkar, former Bombay High Court Justice Rekha Baldota and ex-CBI director DR. Karthikeyan to inquire the alleged encounter killing of four gang rape and murder accused of 26 years old veterinarian in Telangana last November. They commission was asked to submit the report to the Apex Court within six months.
It is further stated by a three - member bench headed by Chief Justice SA Bobde no forms of interference by any authority into the matter pending before the three member’s commission until further orders.
The commission shall have the power to undertake investigation and inquiry of the 6th December encounter killings details under the Commission of Inquiry Act.
The panel seek for the extension of such inquiry in the view of the COVID-19 pandemic, which further states:
“…hindered the sittings of the Inquiry Commission as the three members of the Commission reside in different cities and the place of inquiry is in a wholly different city as well”, Application filed in Supreme Court.
On July 24, 2020, when the petitioner prayed for the issuance of guidelines on the detailed investigation of such fake encounter killings, the three bench judge stated the following:
“How can any court in the world grant relief like this and say there should be no crime. As a lawyer, you have a higher responsibility on you. How can we ensure no deaths in custody?" questioned Cheif Justice S.A. Bobde
The court had previously ordered the completion of the investigation by the panel by September. The Application filed by Advocate K Parameshwar states the following on extension of such time:
“Even though the work of the commission is continuing, the same could not be completed because of the prevailing pandemic situation...Therefore, the inquiry commission is constrained to apply for an extension of time of six months from the date the commission is able to function with physical hearings, spot inspections etc." ; application filed in Supreme Court.
Supreme Court on hearing both the sides on July 24th, 2020 grant an instant extension of another six months for the inquiry of the Hyderabad Encounter killing.
