Guidelines issued to ensure strict compliance with animal slaughter laws during Bakri Eid: Madras High Court
A set of guidelines were issued by the HC on Thursday to make sure that the applicable animal slaughter laws during the upcoming Bakri Eid or Eid-al-Adha celebrations are strictly adhered to.
The court gave these guidelines while dealing with the petition raised in the case of, M/s Madurai North Indians Welfare Association v. Chief Secretary, Government of Tamil Nadu, and Ors. The plea stated that the animals may be slaughtered during Bakri Eid in public places and also in violation of applicable laws, including animal slaughter rules and COVID-19 norms.
The Bench comprising of Justices Dr. Vineet Kothari and Krishnan Ramasamy answered the apprehensions raised in the plea by directing the state to make sure that the Central Government Notification on the issue, Transport of Animals Rules, 1978, and Slaughterhouse Rules, 2001 are to be followed strictly during Eid.
The court stressed that the compulsory following of the guidelines and strict adherence to the rules and laws have assumed more significance due to the pandemic, COVID-19.
The Madras HC observed, "... particularly in Covid-19 period... it is all the more necessary to implement these rules, guidelines in a more stringent manner and public gatherings or slaughtering at public places is avoided at all costs"
Following important guidelines have been issued-
The court further went on to express that, "not only in all times generally, but particularly in COVID 19 period also, which is a serious existential threat to the humanity itself."
It observes that notice comprising of guidelines will not be restricted to the festival of Bakri Eid and it will be compiled in its letter and spirit by all the authorities concerned on the upcoming Bakri Eid and even other religious festivals.
Moreover, the court urged to the leaders in society, like political leaders and religious leaders and other social activists asking them to reproduce the idea of friendliness with animals and nonviolence to them and the good message and spirit which was originally given by the First Prime Minister of our country Pandit Jawaharlal Nehru. He said, ‘Real kindness comes from a sense of friendship with animals.’
States were also directed to file a status report and reply to the legal questions in three weeks. The matter will be followed on 20th August 2020.
