The SC allowed Rajasthan Speaker to withdraw the plea against the order of the High Court.
The Apex Court on Monday allowed the Rajasthan Assembly Speaker CP Joshi to withdraw his petition against the High Court’s order in the disqualification process of the State’s former Deputy CM Sachin Pilot and other 18 Congress legislators.
Senior advocates Kapil Sibal and Sunil Fernandes appeared before the bench of Justices B R Gavai and Krishna Murari, headed by Justice Arun Mishra. They said that they had been informed by their client, to withdraw the case from the Supreme Court.
The senior advocate said that the case in the Supreme Court has become ‘infructuous’ with the State HC, on July 24, passing a detailed order, effectively delaying the disqualification proceedings against Mr. Sachin Pilot and other 18 Congress MLAs for an indefinite period. He further said that the Apex Court had not stayed the HC proceedings, leading to the latter court’s order on July 24, 2020.
The SC dismissed the Speaker’s plea to stop the High court from deciding the validity of the anti-defection notices he has issued to Mr. Pilot and the other 18 MLAs. Further to this the Apex Court on July 23, said that the HC order on the next day would be the final decision of the SC on the Speaker’s petition.
The Speaker had approached the Apex Court against a July 21 order of the State’s HC to adjourn the disqualification proceedings till July 24, 2020.
The former Deputy CM and other rebel MLAs had approached the State’s HC against the disqualification notice issued by the State Assembly Speaker.
“The SLP ( Special Leave Petition) is withdrawn with the liberty to file a fresh SLP and to keep all the grounds open,” Senior Advocate Sunil Fernandes said before the bench.
The State’s HC had passed an order on July, 24 maintenance of status quo on the disqualification notice issued by the State Assembly Speaker to the former Deputy CM of the State Mr. Sachin Pilot and other 18 dissident Congress MLAs.
