A Division Bench of Bombay High Court has passed orders while hearing the plea of Dr. Varavara Rao, a Telugu poet, and a literary critic through video conferencing. This plea has again highlighted the apathy of the state and the mismanagement that exists in Maharashtra during a pandemic. The division bench had passed orders on 28th July 2020 while hearing Varavara Rao's plea against the rejection of interim bail and a petition seeking directions to Taluja jail authorities to submit a detailed report along with medical papers of the treatment of Rao as he was kept at the jail hospital.
The petitioner's advocate Mr. Sudeep Pasbola had argued before the court on behalf of the aggrieved family of the petitioner, who was not allowed to contact Mr. Rao even after contacting the hospital and the jail authorities multiple times. They argued that the petitioner's condition is serious and his family living in Hyderabad has no information about his conditions. The petitioner's advocate also questioned the secrecy about the petitioner's health maintained by the state. The council of the National Investigation Agency refuted these arguments by stating that if the hospital permits to share the information of the patient then they have no problem. Moreover, there is no need to worry about the treatment being given to Mr. Rao as the Nanavati hospital is one of the best in the city and as per the Indian Council of Medical, Research secrecy has to be maintained.The court then asked the state if there are any problems in releasing the information to which the state replied that it has no objection in releasing the information.
Finally, the court directed the Nanavati hospital to submit a report on the health status of Rao and the treatment that is being given to him. Through these orders, the court provided some relief to the family who was kept in dark about the condition of the petitioner. The aggrieved family had also reached out to the Human Rights Commission and the Home Minister of Maharashtra by writing a letter when they did not receive any updates on the petitioner's health for 12 days. This order of the court will definitely be welcomed by the family.
