In a gangrape case, Bombay High Court observed held that an accused get not be granted bail on the ground that the DNA report of a child who is born after the gangrape does not establish paternity of the accused and the court rejected the bail application filed by one of the three accused Vaibhav Ubale. The application filed by 25 years old Ubale was heard by Justice Bharati Dangre, she observed that the DNA report does not support paternity is no ground for releasing an accused on bail at this stage and also it is likely that the accused will pressurize the victim if he will be released and hence, he cant be released on Bail.
The accused was arrested as an FIR was filed against him for charging him for the offenses punishable under Section 376 of the IPC and Sections 3,4,5 (J)II), 6, 8, and 12 of the Protection of Children from Sexual Offences Act,2012. On September 5, 2019, a charge sheet was filed in the Court of District and Special Judge after an investigation. The three accused were charged under Section 376(d) of the Indian Penal Code along with the relevant provisions of the POSCO Act. The accused was roped in the offense without any reason was submitted before the court by Advocate Subhash Karmarkar and Advocate Samarth Karmarkar.
On November 6, 2018, the victim gave birth to a baby girl, at the time of pregnancy she was below 18 years, an official from Koregaon Park Police station inquired from the victim's mother and took a statement of the victim in presence of her mother and member of the Woman Vigilance Committee. After hearing the submissions on behalf of both the prosecution and accused court observed "The charge sheet contains sufficient material against the applicant. The case against the applicant is a serious one of committing gang rape by three persons and taking advantage of a situation of a poor helpless victim girl. The applicant has indulged in the act of rape." Hence, the applicant's bail application was rejected by the court.
