A petition was filed in the Madras High Court which demanded the State of Tamil Nadu to provide all the necessary boarding and lodging to the impecunious mentally ill people. The petition was pleaded before the High Court to direct the State to undertake all the necessary actions to provide the mentally ill people with proper food to eat and further provide shelter for them, and the petition urged the High Court to direct the State to provide shelters to such people after conducting a Covid-19 test on them. This plea was filed before the High Court of Madras in the case of M. Karpagam vs. The Chief Secretary to Government of Tamil Nadu and others. The matter was heard by a bench comprising of two judges Justice MM Sundresh and R Hemalatha.
The court observed that the mentally ill are not being taken care of by the private homes across the State, thus the Court was of opinion that the State should pass appropriate directions to take care of these people. The counsel for the Government tried to convince the Court about the working of the Government towards the mentally challenged people but the bench observed that the petition does highlights the incompetency of the Government concerning the mentally challenged people.
Therefore, the bench ordered the State to conduct an inspection on this issue and the court also directed the State Commissioner for the Differently Abled to file a report highlighting the state of the concerned people after inspecting both public roads, and Governments and Private homes which are established for the sake of the mentally ill people.
After inspecting the issue, the bench also asked the State of Tamil Nadu to file a report in which all the alleviating measures should be mentioned regarding such people. The Court has ordered the next hearing for the case on the 18th of August, 2020 after the filing of the report.
