The CLAT 2020 issue continues, on 5/08/2020 Delhi High Court issued a notice on a plea impugning the CLAT-2020 notification, as it mandates the physical presence of the student at the examination center.
The plea is filed by V Govinda Ramanan, questioning and stating that the notification which is issued by the CLAT consortium regarding the organization of the exam on 22 August 2020 is contradictory with the advisory issued by the Government of India regarding maintenance of social distancing. The plea contended that the notification issues by CLAT Consortium is erroneous//illegal and violates right to Life enshrined under article 21 of the Constitution of India.
The said plea is seeking a direction for conducting “Home Based Online Exam”
CLAT 2020 was scheduled to be organized on 22 August through an Online, Centre based exam. Previously, through notification Consortium informed about the increased number of centers of exam and asked students to amend their choice of exam center to as near as possible for the convenience of students so that they do not travel long routes for reaching their Exam centers amid this ongoing Pandemic.
The single-bench of Delhi High Court through Justice Jayant Nath has asked the Centre and the Consortium of Law Universities to file their replies in this matter by August 10, 2020.
Earlier the exam was scheduled to be organized in offline mode only but seeing the ongoing conditions the Consortium through notification intimidated that an offline test would require a large scale of movement to their limited exam centers with huge logistic and question papers and answer sheets which is not possible amid ongoing pandemic. On the other hand, an online exam from hope will not ensure transparency and fairness and maintenance of necessary facilities. Hence, it concluded that an online exam will be conducted with the required compliance of physical distancing.
Another notification which is issued on 5 August 2020 states that Consortium has postponed the exam which was scheduled for 22 August to further notice in this regard.
The notification reads:
“The Executive Committee of the Consortium of National Law Universities met on 5 August 2020 and unanimously decided to postpone the CLAT 2020, from its scheduled date of August 22, 2020, until further notice."
