Allahabad HC directs the U.P. Government on social distancing.
While hearing on Wednesday the Allahabad High Court on a suo moto case laid down certain norms for the Uttar Pradesh government to adhere in respect to the social distancing criteria.
The rule of "Do gaj doori mask pehna zaroori" in the light of this COVID pandemic was stated in order to maintain a safe distance between two individuals which lately the people in the state where failing to follow neither was the state government was interested in taking any action for the same. The order stated that people have misunderstood the unlock phase of the government where distancing rule was not abided and they were freely roaming without precautions.
A Division bench comprised of Justices Siddhartha Varma and Ajit Kumar took a view of this point and ordered the state police and the district administration to keep an eye over the people crowding near shops and maintain a safe distance between them. The order stated, “It matters little that the queue goes to be a kilometer long. This physical distancing will be for the good of the shopkeepers and also for the good of the people who crowd at these shops.”
Earlier Mr. S. D. Kautilya learned Advocate had presented with an affidavit stating that Nagar Nigam had carried out robust activity to ensure that the encroachments were removed. But during the hearing, the advocates representing the petitioner said otherwise. There were photographs presented in order to prove the same. On which the bench stated that Nagar Nigam though succeeded in removing these encroachments but still have to carry out this work by maintaining the rule and actively ensuring that there isn’t any re encroachment taking place. Further stated that Nagar Nigam has to make sure all public places are encroachment free by reminding the concerned police to take appropriate actions.
There was even mentioning how government hospitals are failing to provide the required facility and care to patients affected as many people are turning towards private hospitals which indicate the conditions of government hospitals. The bench even denied the affidavit submitted by Mr. Goyal, learned Senior Counsel regarding some backlog that got improved. They stated that this affidavit lacked statistics therefore it failed to satisfy any saying from the affidavit.
The high court in this view stated certain directions to the state authorities, which were: to see vigorously that no two individuals in public remain within a distance of two yards from each other if any violation by this rule then the premises should be closed down. It also made directions with respect to policemen and nursing homes and clinics.
These directions are required to be complied and notified within 12 hours to respective authorities.
The high court set out the next date on 7th August 2020.
