A representation was made by the Alumni of the National Law University, Delhi, raising concern regarding the methods adopted by the Criminal Law Reform Committee for consultation process, to the Vice Chancellor of the University who also happens to be the chairperson of the committee, asking to halt the process.
The alumni in their statement wrote that they are concerned as well as disappointed with the way in which a task of this magnitute with profound implication of the criminal justice system in India is being taken up by the committee. They further stated that they had been following all the developments around the committee closely since its formation and many of them struggle to engage with the process.
Union Ministry of Home Affairs constituted a five-member committee vide Notification Feb 1, 2019 Judicial Cell (Part I) dated May 04, 2020 to recommend criminal reforms in India. These following professors of the National Law University comprise the committee, including the chairperson and the convenor:
The committee has been further criticised for “insufficient public engagement” by the Alumni.
In their statement they asserted that “The opaqueness surrounding the proceedings of the Committee are detrimental to the interest of the university, the committee and the future of the criminal justice in India. This is an indictment to the university’s callous and exclusionary approach as it has publicly attested to exercising full autonomy in all functional aspects."
The Alumni opined that in entrusting exercise of such nature to a public university there comes the responsibility of ensuring that the exercise is carried out as a matter of criminal justice affecting the life and liberty of all individuals and particularly the section of the society which is the most marginalised.
The Chancellor has been urged by the alumni to see that high standards for legal research, policy making and debate are adhered by the committee.
