Madras High Court bench comprising Justice M Sathyanarayanan and Justice N Seshasayee pronounced the order disposing of various writ petitions pertaining to the dispute of succession of the office of waqf trusts on 8th June 2018. The bench held that in these cases the jurisdiction to decide on the successor to the office of the trustee rests with the civil court. The bench revealed receiving a plethora of letters, many without the sender’s address during the hearing of the dispute often causing many hindrances and disturbances. Despite bringing it to the notice of the counsels of both parties by the court, these acts did not stop. The court observed this conduct to be pernicious, and this attituding of interfering with the course of justice as contempt of the court. The court expressed that it can act sternly against such people, however, it decided to maintain peace upon them for the time being. The court, to everyone’s surprise, also explained the various causes of delay which hindered the process of justice.
