A division bench of Karnataka High Court comprising of Hon'ble Chief justice of Karnataka and Justice BV. Nagarathna had passed an order and order dated 16th April 2020 to ensure the rights of the citizens by extending the life of all interim orders. In this order, the court exercised its jurisdiction under Articles 226 and 227 of the Constitution of India to ensure that the citizens are not deprived of their rights to approach the court during the pandemic. The order had extended the life of all interim orders passed by the Karnataka High Court, District courts, civil courts, Family courts, all the tribunals, and Labour courts by a month.
The court also extended the life of all the eviction, dispossession, or demolition orders passed by the High court, District courts or civil courts by one month. Through this order, the court gave relief to the people who would have to face difficulties in filing appeals due to lockdowns and non-functioning courts. This order, however, would expire on 7th August 2020 and the High Court of Karnataka was presented with the same issue again as the lockdowns in the state had not been completely lifted and courts were still not functioning normally. When this matter was again listed before the division bench of Karnataka High Court, the court noted that the situation in the state has yet not improved and extended the order dated 16th April 2020 till 30th September 2020. The court acknowledged the problems that the litigants will face if the orders are not extended and also urged the State government and municipal authorities to slow down the process of demolition and eviction of persons since it will be impossible for the citizens to approach the court for redressal of their grievances.
This action of the court will ensure that the rights of the citizens to approach the court are not violated.
