The Apex Court issued a notice on a plea seeking directions to restrict unregulated broadcast by news channels from assassinating the dignity of individuals in the name of freedom of press. The Top Court asked for a reply from the Centre on a plea seeking framing of regulations to control "unregulated" media channels in the country.
The bench, comprising Justices A. S. Bopanna and V. Ramasubramanian, headed by Chief Justice S. A. Bobde was hearing a petition filed by advocate Reepak Kansal. The petition was filed in order to protect the right to live with dignity which is guaranteed under Article 21 of the Indian Constitution.
The petition was filed by advocate Reepal Kansal in order to set up an independent authority to control and regulate the development of broadcasting services in India. The petition also requested directions to "restrict the assassination of dignity" of individuals, communities, and political organizations by the news channels in the name of freedom of press.
The petitioner in its plea also referred to journalist Arnab Goswami. He further added that the said anchor had called some attackers as ‘Sonia ke gunde” and had assassinated the dignity of individuals as well as political parties. There are a number of FIRs registered against him across the country in the past and after the said false and baseless reporting on public platforms.
Advocate Reepak Kansal also submitted that “The question of the legal control over electronic broadcasting sources i.e. radio, television and internet protocol television is a topic to be considered in recent times in the country. Nowadays there is the only circulation of fake news, bad journalism, or hate speeches in the name of journalism. It has also become a platform to attack the dignity of an individual or community and political organizations. He also added that the live debates and reporting on the electronic broadcasting channels should be regulated by a statutory body.
Advocate Reepak Kansal in his plea has also requested an independent authority to be known as the Broadcast Regulatory Authority of India to regulate and control the broadcasting services in India.
Further to the hearing the bench directed the Centre for a response on this and listed the matter for the next hearing after four weeks.
