A petition, on behalf of twenty, tenth standard students has been filed before the Bombay High Court asking for the re-evaluation of results for March-April public examination, 2020 conducted by the National Institute of Open Schooling. The said institute decided to evaluate scores of theory paper, taking into consideration the scores of practical exams in contradiction to their system of marking.
The exams, which were initially supposed to be held in March or April were shifted owing to Covid-19. Later on, 10th July 2020 a notification was issued stating that the exams were canceled. As per the assessment scheme, the last three examinations for which the students had registered, that could not be held would be marked by the tutor and the practical marks of those subjects would be taken into count for the calculation for the academic performance of a student.
On August 6, the results were published. The students “to their utter shock” found out that the marks allotted them to were less in comparison to their performance and also the potentiality of the students were in doubt.
The petition also asserted that
“The conduct of the respondents in carrying out the assessment in contravention of its assessment scheme is completely arbitrary and violative of the petitioner’s fundamental rights as guaranteed under Articles 14 and 21 of the Constitution of India.
The assessment carried out by the respondents in contravention of its own assessment scheme has grossly affected the petitioner’s right to equality before the law and equal protection of the law, guaranteed under Article 14 of the Constitution and right to life as guaranteed under Article 21 of the Constitution, as the same has severely prejudiced the petitioner’s future academic career”.
Therefore, the petitioners through their Advocate Abhay Anturkar filed a petition seeking reassessment of their results which should be in line with NIOS’s guidelines for the said public examinations.
