A PIL has been filed regarding the implementation of Citizen’s Charter and Grievance Redressal Bill 2011 also known as The Right of Citizens for Time Bound Delivery of Goods and Services and Redressal of their Grievances Bill, 2011. Citizen’s Charter is basically a commitment by a public organisation regarding the standards of service which it delivers. It works on the principle of transparency and citizen friendly. The petitioner Bhartiya Matdata Sanghatan has filed the petition stating that corruption is a plague which destroys the principle of rule of law, democracy, human rights and the welfare of society. India has been ranked 81st in the Corruption Perception Index, 2025 of Transparency International.It highlights the failure of the government in appointing lokpal at the Centre and lokayukt at State level according to the act of 2013 due to which common man suffers.
Petitioner condones that Citizen’s Charter has not been recognised as fundamental right of the citizens under Article 21 of Indian Constitution.
In the petition a case law Subhramanian Swamy v. Manmohan Singh (2013) has been referred according to which Corruption threatens constitutional governance and democratic structure and the duty of the court is to strengthen the anti corruption laws in the fight against corruption.
The petitioner points out the shortcomings of the present Citizen’s Charter:
Petition also compares the Charter of other countries that are similar in nature. It was contended that the Rights of Citizens for Time Bound Delivery of Goods and Services and Redressal of Grievances Bill of 2011 was presented before the 15th Lok Sabha but lapsed due to resolution therefore it is a voluntary scheme.
The petition prays that Citizen’s Charter to be recognised under Article 21 of the Constitution and comply with the provisions of the Charter regarding Grievance Redress Officer in every Department. Also make the Charter mandatory by reintroducing in Lok Sabha.
