Road accidents are one of the major issue which was recognised by the Prime Minister Narendra Modi in 10th edition of ‘Mann ki Baat’. During the interaction he promised cashless treatment of road victims for upto 50 hours. As India is one of the signatories of Moscow Declaration 2009 and Brasilla Declaration 2015, National Policy on Road Safety 2015 has been formed which provided medical treatment upto a certain amount and time period. The petition under Article 32 of the Indian Constitution has been filed by a Delhi based resident Rakesh Kumar Singhal through Advocates Pankaj Singh and Pawan Singh. While considering the petition Chief Justice of India Sought the assistance of Attorney General in the matter. The petitioner wants to draw the attention of the plight of the victims of road accidents. The counsel appearing on behalf of petitioner stated that victims does not get immediate medical assistance because either the nearest hospital is private or there is absence of any relative or friend of the victim who can bear the cost of the treatment. Due to the delay in treatment either the victim dies or suffer severe disability.
In India the supreme authority is the Constitution of India which promises to protect the life of its citizens under Article 12 which is also referred as one of the fundamental rights. There are Directive Principles which casts a duty on the government to promote the welfare of the society. He laid emphasis on the report that has been published on the website of NITI Aayog quoting that the BRICS nations contribute 20% of the total world’s road accident and among them India tops the list. In 2016 our roads saw 4,80,652 accidents that cause injury to 4,94,624 and killing 1,50,785 person. This can be referred on an average that there are 17 deaths occuring every hour. The number of road accidents have been increasing since 2005 till date. The accidents severity can be understood by the number of person killed per 100 accidents, gone up from 29.1 in 2015 to 31.4 in 2016.
According to World Health Organisation (WHO) road accidents are one of the major sources of deaths and threat to the public health and it has to be given more importance.
In the petition relief sought by the petitioner is that medical assistance must be provided to the victim immediately. Cashless treatment to the victim and the treatment to be free of cost. The petition is been admitted and will be heard on 23rd July, 2018.
