A group of 25 taxpayers were granted interim relief by the Bombay HC bench comprising of Justice MS Sanklecha and Justice SK Shinde on 29th June by directing the state authorities to accept tax returns without Aadhaar linkage. This was in response to a writ petition filed by this group seeking directions for acceptance of income tax returns filed by them with the CBDT and Income Tax Department without insistence on the Aadhaar linkage.
The abovesaid petition was first heard on 21st June. The petitioners had challenged the Revenue Department’s persistent insistence on linking their PAN Card with their Aadhaar card in order to file tax returns. The petitioners had relied on the recent court orders by the Delhi High Court and Punjab and Haryana High Court while hearing similar petitions. Countering the petitioners, Additional Solicitor General Anil Singh, appearing on behalf of the respondents had argued that the existing system at CBDT didn’t allow for acceptance of IT return forms without Aadhaar card details. The court ordered for acceptance of returns filed by the petitioners without Aadhar number, enrolment or any linkages with PAN details. The court also offered the petitioners to deposit their returns in the physical form with the jurisdictional Assessing Officer on or before 2nd July 2018 in case the system fails to accept such returns by 30th June.
The directions made in this order were exclusively restricted to this case and the matter has now been posted to 17th July.
