The Right to Information (RTI), is a revolutionary step of the parliament which aims to promote transparency on government institutions in India. It came into existence in the year 2005, after an immense struggle of anti-corruption activists. In the case Aseer Jamal v. UOI, SC reserved its decision regarding the non-accessibility of Right to Information to a large population of India. The concern regarding the matter was addressed by Attorney General KK Venugopal, he highlighted the various sections of the RTI Act of 2005. The section which were considered, during the proceedings were as follows:
Section 6 of RTI Act, 2005
The section states that Central or State Public Information Officer are under an obligation to provide all reasonable assistance to reduce in writing a request orally made by the applicant, when the applicant is not in that condition to do so.
Sub section 3 of section 6 states, that when the person is not aware of the correct PIO, to whom application has to be filed, in such cases the PIO who received the application will send it to the desired PIO.
Section 5 and 6 of RTI Rules
According to these two rules, a person below poverty line is exempted from paying the application fees. The payment mode has been widened, it can be done through cash, DD, cheque and electronic means such as RuPay card.
The AG also informed that in many States there is a provision of accepting the application of RTI trough online mode, which is much simpler and cost effective than offline mode. Therefore the court must give direction to all the States to accept such application through online mode only. AG requested the bench to issue guidelines where the rules of RTI are lacking.
The bench consisting Chief Justice Dipak Mishra, Justice D.Y. Chandrachud and Justice A.M. Khanwilkar asserted that few guidelines has to be issued, in the RTI Act 2012 to secure access to the right to information to all those who are visually impaired, orthopaedically handicapped, and those who are not able to write Hindi.
